Terms of Service

Welcome to Swing AI. These Terms of Service (“Terms”) govern your access to and use of the Swing AI mobile application and any related services we provide (collectively, the “Service”). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.

2. Your account

You are responsible for any activity that occurs through your account, for keeping your login credentials secure, and for the accuracy of the information you provide. Notify us promptly if you believe your account has been compromised.

3. How the Service works

Swing AI analyzes short videos of your golf swing using computer-vision and machine-learning models, and returns feedback intended to help you understand your swing mechanics. The feedback is generated automatically; it is informational only and is not professional coaching, medical advice, or a guarantee of any particular outcome or improvement.

4. Your content

You retain ownership of the videos, images, and other content you submit to the Service (“Your Content”). By submitting Your Content, you grant Swing AI a limited, worldwide, royalty-free license to host, store, process, and display Your Content solely for the purpose of operating and improving the Service for you. We do not sell Your Content.

You represent that you have all rights necessary to submit Your Content and that doing so does not violate any law or any other person’s rights.

5. Acceptable use

You agree not to:

• Use the Service to harass, harm, or invade the privacy of any person, including by uploading videos of others without their consent;
• Reverse engineer, decompile, or attempt to extract the source code or models behind the Service, except where applicable law permits;
• Interfere with, disrupt, or attempt to gain unauthorized access to any part of the Service;
• Use the Service to build a competing product or train a competing model; or
• Use the Service in violation of any law.

6. Purchases and subscriptions

Some features may require a one-time purchase or a recurring subscription billed through the App Store or Google Play. Pricing, billing cycles, and renewal terms will be shown at the point of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Manage or cancel your subscription through your App Store or Google Play account settings.

7. Free trials

If we offer a free trial, you will be automatically enrolled in the corresponding paid plan when the trial ends unless you cancel beforehand. We will not send a separate reminder; please track your trial period through your store account.

8. Changes to the Service

We may add, change, or remove features at any time. We may also suspend or discontinue the Service, in whole or in part, with reasonable notice when practical.

9. Termination

You may stop using the Service at any time by deleting your account from within the app. We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe doing so is necessary to protect the Service, other users, or third parties.

10. Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Swing AI disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that its swing analysis will be accurate or suitable for any particular purpose.

Swing AI is not a substitute for in-person coaching, physical therapy, or medical advice. Always warm up properly, listen to your body, and consult a qualified professional before making material changes to your swing or training routine.

11. Limitation of liability

To the maximum extent permitted by law, in no event will Swing AI or its affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of or related to these Terms will not exceed the greater of (a) the amount you paid Swing AI in the 12 months preceding the claim or (b) USD $50.

12. Indemnification

You agree to defend, indemnify, and hold harmless Swing AI from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any third party’s rights.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts. Nothing in this section limits any non-waivable rights you have under the laws of your country of residence.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, in-app or by updating the “Last updated” date above). Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
